Terms of Use

Last updated: October 2026

Welcome to SpareRoom ("SpareRoom", "we", "us", or "our"). SpareRoom is a platform that allows property owners and other authorised property holders to advertise available rooms within their properties to individuals seeking accommodation.

By accessing or using SpareRoom, including creating an account, listing a room, contacting a property owner, or using any of our services, you agree to be bound by these Terms of Use ("Terms").

If you do not agree with these Terms, you should not use SpareRoom.

1. Purpose of the Platform

SpareRoom provides an online platform that connects:

  • Property owners or authorised occupants who have an unused room; and
  • Individuals seeking a room or residential accommodation.

SpareRoom is intended primarily for the listing and arrangement of residential room accommodation.

The platform is not intended to convert private residential properties into hotels, guest houses, short-let businesses, or other commercial accommodation establishments unless expressly permitted by SpareRoom and applicable law.

2. Eligibility to List a Room

To list a room on SpareRoom, a user must:

  1. Be at least 18 years old;
  2. Be the legal owner of the property or have sufficient authority from the property owner to list the room;
  3. Have the legal right to make the room available for occupation;
  4. Provide accurate and complete information about the property and room;
  5. Comply with all applicable laws, regulations, tenancy requirements, building rules, and applicable homeowners' or landlords' association rules; and
  6. Ensure that the room is genuinely available for the purpose stated in the listing.

Where required, SpareRoom may request reasonable evidence of a user's authority to list a property.

3. Non-Commercial Use of Listed Rooms

SpareRoom permits property owners to list unused or spare rooms that are not otherwise being used for commercial accommodation purposes.

For the purposes of these Terms, a room will generally be considered suitable for listing where it forms part of a residential property and is being made available for residential occupation.

Users must not use SpareRoom to:

  • Operate an unauthorised hotel, guest house, hostel, or short-let accommodation business;
  • List rooms that are already being commercially operated through another accommodation business;
  • Misrepresent a commercial accommodation business as a private residential room;
  • List rooms for purposes that are unlawful or prohibited by applicable regulations; or
  • Circumvent licensing, registration, zoning, planning, tenancy, tax, or other legal requirements.

SpareRoom reserves the right to remove any listing that it reasonably believes is being used for unauthorised commercial accommodation.

4. Listing Requirements

All listings must contain truthful, current, and sufficient information, including where applicable:

  • Property location
  • Room type
  • Available facilities
  • Monthly or agreed rental amount
  • Deposit requirements
  • Availability date
  • House rules
  • Whether the room is furnished or unfurnished
  • Whether utilities are included
  • Number of occupants permitted
  • Any material restrictions or conditions relating to occupation

Users must not deliberately omit material information that could reasonably affect a prospective occupant's decision.

5. Accuracy of Information

Property owners are responsible for ensuring that all information contained in their listings is accurate.

A property owner must not:

  • Use misleading photographs;
  • Advertise a room that is unavailable;
  • State a price that does not reflect the actual rental terms;
  • Claim to provide facilities that are not available;
  • Misrepresent the size, condition, location, or accessibility of a property; or
  • Impersonate another person or property owner.

SpareRoom may amend, suspend, or remove listings that contain inaccurate, misleading, or incomplete information.

6. Property Owner Responsibilities

Property owners remain solely responsible for their properties and any arrangements they enter into with prospective occupants.

Property owners are responsible for:

  • Maintaining the property in a reasonably safe and habitable condition;
  • Complying with applicable housing and property laws;
  • Obtaining any consent, permission, licence, or approval required to rent or occupy the room;
  • Disclosing relevant house rules and restrictions;
  • Dealing honestly and fairly with prospective occupants; and
  • Honouring any agreement made with an occupant.

Listing a property on SpareRoom does not transfer responsibility for the property to SpareRoom.

7. Occupant Responsibilities

Individuals using SpareRoom to find accommodation must:

  • Provide accurate information about themselves;
  • Use the property in accordance with the agreed terms;
  • Respect the property, its occupants, and neighbours;
  • Comply with reasonable house rules;
  • Make agreed payments when due; and
  • Avoid using the property for unlawful purposes.

An occupant must not provide false information or use another person's identity to obtain accommodation.

8. Agreements Between Users

Any tenancy, licence, occupancy agreement, rental agreement, or other arrangement entered into between a property owner and an occupant is an agreement between those parties.

SpareRoom is not automatically a party to such an agreement.

Users are responsible for reviewing and understanding any agreement before accepting it.

Where appropriate, users should obtain independent legal advice before entering into a tenancy or other legally binding arrangement.

9. Payments

Unless expressly stated otherwise, SpareRoom does not guarantee, process, or hold rent, deposits, or other payments made between property owners and occupants.

Users should exercise appropriate caution before transferring money and should verify the identity, authority, and legitimacy of the other party.

SpareRoom will not be responsible for losses resulting from payments made directly between users, except to the extent required by applicable law.

10. Prohibited Activities

Users must not use SpareRoom to:

  • Facilitate illegal activities;
  • Defraud or deceive another user;
  • Post fraudulent or fictitious listings;
  • Collect money for properties they have no authority to offer;
  • Harass, threaten, or abuse another user;
  • Discriminate unlawfully against prospective occupants;
  • Upload malicious software or harmful content;
  • Attempt to gain unauthorised access to another user's account;
  • Scrape, copy, or commercially exploit SpareRoom's content without permission;
  • Use the platform for spam or unsolicited advertising; or
  • Engage in any activity that may damage the reputation, security, or operation of SpareRoom.

11. Verification and Safety

SpareRoom may introduce verification measures designed to improve user safety and platform integrity.

However, verification does not constitute a guarantee that a user, property, listing, or transaction is genuine, safe, suitable, or legally compliant.

Users should independently verify important information before entering into an agreement or making a payment.

12. SpareRoom's Role

SpareRoom operates as a platform for connecting property owners and prospective occupants.

Unless expressly stated otherwise, SpareRoom does not:

  • Own or manage the properties listed on the platform;
  • Act as the landlord, tenant, agent, or property manager of users;
  • Guarantee that a room will be rented;
  • Guarantee the accuracy of every listing;
  • Guarantee the conduct of any user; or
  • Guarantee that a particular property will meet a user's expectations.

Users are responsible for conducting their own enquiries and making their own decisions.

13. Listing Review and Removal

SpareRoom reserves the right, but does not assume an obligation, to review listings and user activity.

We may, at our discretion, remove, restrict, suspend, or deactivate a listing or account where we reasonably believe that:

  • These Terms have been breached;

  • The property is being used in violation of applicable law;
  • The room is being offered for unauthorised commercial accommodation;
  • The user poses a safety or security risk;

  • You have the right to submit the content;
  • The content is accurate to the best of your knowledge;
  • The content does not infringe another person's rights; and
  • The content does not contain unlawful, offensive, fraudulent, or misleading material.

You grant SpareRoom a non-exclusive right to use, reproduce, display, and distribute your listing content for the purpose of operating, promoting, and improving the platform.

15. Privacy

SpareRoom may collect and process personal information in accordance with its Privacy Policy.

Users should avoid sharing unnecessary sensitive personal information through public listings or communications.

16. Intellectual Property

All intellectual property rights in the SpareRoom website, application, branding, logos, software, design, and platform functionality belong to SpareRoom or its licensors unless otherwise stated.

Users may not copy, reproduce, modify, distribute, sell, or commercially exploit SpareRoom's intellectual property without prior written permission.

17. Limitation of Liability

To the extent permitted by applicable law, SpareRoom shall not be liable for losses, damages, disputes, injuries, fraud, property damage, or other consequences arising from interactions or agreements between users.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

18. Indemnity

To the extent permitted by law, a user agrees to indemnify and hold SpareRoom harmless against claims, losses, liabilities, damages, costs, or expenses arising from:

  • The user's breach of these Terms;
  • The user's unlawful conduct;
  • Information or content submitted by the user;
  • The user's property or listing; or
  • An agreement or dispute between the user and another person.

19. Changes to These Terms

SpareRoom may update these Terms from time to time.

Where material changes are made, SpareRoom may provide reasonable notice through the platform or other appropriate means.

Continued use of SpareRoom after the updated Terms take effect constitutes acceptance of the revised Terms.

20. Suspension and Termination

Users may stop using SpareRoom at any time.

SpareRoom may suspend or terminate an account where a user breaches these Terms or where suspension or termination is reasonably necessary to protect the platform, its users, or comply with applicable law.

Termination does not affect rights or obligations that arose before termination.

21. Dispute Resolution

Users should first attempt to resolve disputes directly and amicably.

Where a dispute cannot be resolved, the parties may pursue any remedies available to them under applicable law.

Nothing in these Terms prevents a user from exercising any statutory or legal right that cannot lawfully be excluded.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Nigeria, unless otherwise required by applicable law.

Any dispute concerning these Terms shall be subject to the jurisdiction of the appropriate courts of Nigeria.

23. Recovery

On SpareRoom, the house owner has a right to recover their premises after expiration of the payment made by the user, within 24 hours of such expiration. The house owner shall not be held liable for any belongings damaged or lost.

24. Contact

If you have questions, complaints, or concerns regarding these Terms or a listing on SpareRoom, you may contact us through our Contact page.
